The Agreement provides that Crescent will record a Restrictive Covenant that prohibits certain activities on the Contaminated Area of the Crescent Property and that the Department covenants not to sue or take other civil or administrative action against Crescent and any subsequent owners of the Crescent Property related to the Existing Contamination on the Cmscant Property.
